Steps you need to take after the accident to lodge your claim:

1.     You need to call the Police and report the accident immediately. You should obtain a Police event number.

2.     You should go to the hospital or your general practitioner (GP) and obtain treatment for any injuries you have sustained. Make sure your GP or the hospital records how your accident occurred and records all the injuries you have sustained, even those injuries that might seem minor at the time. If you went to the hospital first, you may need to consult your GP who will provide you with an “Accident Notification Form” or a medical certificate. You will need this form to lodge your CTP claim.

3. If because of the car accident you need time off work or payment for medical treatment, you need to submit an Application for Personal Injury Benefits form.

4. You will need certain details before you can lodge your CTP Claim:

  • The details of the vehicle that hit you (to identify the CTP insurer)
  • Police event number
  • Medical certificate from your GP (Filled by your GP)
  • Personal injury benefits form (Filled by you)

5. It is best to submit your claim as soon as possible. To receive lost wages, you must submit your claim within 28 days of the accident.

7. Once your claim has been accepted, the insurer will issue you with a claim number. You can provide this claim number to a Physiotherapist who will assist you with your injury and provide rehabilitation services.

What is Section 78?

So you’ve received a section 78 notice. First of all, what is a section 78 notice?

Section 78 is a notice issued by the WorkCover insurer used by your employer which outlines the decision to decline your claim and the reasons for it. They can either decline medical treatment and expenses or weekly wages or sometimes both. 

For an injured worker, receiving a section 78 notice is usually not the end of the line. The insurer normally uses evidence from an independent medical examiner (IME) and other sources to collate evidence to decline your claim. 

The insurance company can decline certain parts of a Workers Compensation claim such as particular requests for treatment. For example, a patient may receive a denial notice for a treadmill that they were recommended by a specialist. The insurer stated: “We are therefore disputing liability in relation to the request for a treadmill only.” A big red flag to help patients identify if their claim has been denied is if their weekly payments have ceased or their medical expenses are not being paid for or referrals approved.

You also have an option to request an internal review. Internal review is a lengthy and time consuming process which normally does not change anything. You can argue the case yourself, but it’s best to speak to a lawyer who specializes in personal injury matters for advice on how to respond to a section 78 notice.

We recently looked after a patient who was T-boned while driving his car and was hit by a car who failed to stop at a red light.
This patient saw his GP and reported general neck pain and discomfort in other parts of the body.
Rest and pain killers were prescribed to ease the symptoms as the patient presented with no major symptoms.
A precautionary x-ray was also done.
The x-ray results revealed multiple (stable) Cervical fractures
The patient was immediately rushed to a hospital where he was seen by a Neuro specialist
As the fractures were stable, a neck brace was given go further protect the area.
And there you have it. The importance of seeing a GP as soon as possible after a motor vehicle accident.

Other Neck Injuries

While whiplash is probably the most common neck area injury, there are other problems that can occur after a blunt-force impact. If you notice tensing or discomfort in the muscles around your neck in the days following your crash (muscle spasm), it is important to have a doctor examine you immediately. The force of an accident can affect the underlying bone structure without there necessarily being a fracture. X-rays, CT and MRI scans are often used by medical experts to diagnose such injuries.

How to receive Mobile Physiotherapy treatment and rehab 

  • With your claim number, your first Physiotherapy session is automatically approved
  • After your first session, we will provide a report to your CTP insurer and up to 8 sessions of Physiotherapy may be approved

If you have a claim number, we will bill the insurer directly and there will no out of pocket expense for you.
